TN Visa USMCA (formerly NAFTA) Occupation of Management Consultant is incontrovertibly the most popular among all categories. However, it is also the most scrutinized by Immigration Officers.

The TN visa management consultant category was first listed in the United States-Canada Free Trade Agreement (FTA) in 1989 and was available only to Canadian citizens. [54 Federal Register 12 (Jan. 3, 1989)].
In 1994, the management consultant occupational position was included in the NAFTA list of available positions for Canadians and Mexicans. See 58 FR 69205 (Dec. 30, 1993). The United States-Mexico-Canada Agreement (USMCA) replaced NAFTA in 2020, but “Management Consultant” remained as a qualifying occupation for the TN visa.
TN Visa Management Consultant Job Description
According to NAFTA, “Management consultants provide services that are directed toward improving the managerial, operating, and economic performance of public and private entities by analyzing and resolving strategic and operating problems and thereby improving the entity’s goals, objectives, policies, strategies, and administration, organization, and operation” NAFTA Handbook, pg. 145.
Essentially, a TN management consultant visa is for a qualified professional designated to help businesses or organizations improve their performance by providing expert advice to solve problems, hence promoting growth.
TN Visa Management Consultant Requirements:
#1. Education and/or professional experience
Eligible applicants for a TN Visa must possess at least one of these:
- A Baccalaureate or Licenciatura Degree
- At least 5 years of experience as a management consultant
The USCIS released a policy update on June 4, 2025, titled “Professionals under the United States-Mexico-Canada Agreement (USMCA)” (PA-2025-05), which tightened the standards for TN visa adjudication. And a key change is that work experience will no longer be accepted as a substitute for a degree unless the USMCA job category explicitly allows it.
However, it’s essential to understand that “5+ years of experience” is explicitly stated as an alternative to the degree requirement in the TN Management Consultant category. Thus, Management Consultant remains one of the few TN visa categories you can still apply for without a degree.
Also, individuals applying for the Management Consultants TN Visa with an appropriate degree must note that if the degree was obtained outside the U.S., Canada, or Mexico, they must submit an academic equivalency evaluation.
#2. Must not be involved in an active management role of the company or a department, and cannot fill a regular or permanent position
Management consultant TN status applicant, as per the guidelines, cannot fill any regular or permanent position within the company. Instead, he or she can only act as an outside consultant to the company, reporting and giving suggestions and recommendations to the company without helping implement them.
It should be noted that consultants’ engagement often includes helping to implement their recommendations. In these cases, only limited implementation aligned with a consulting engagement is allowed. When implementation of recommendations is part of the consulting engagement, the Management Consultant must be able to demonstrate that they will not be stepping into an ongoing managerial role.
The TN management consultant can either be an independent consultant or an employee of a consulting firm contracted by US entities to which they provide consulting services.
If an employee of such entities, the management consultant must not assume an existing position or fill a newly created position within the company. He or she may only come in to fill supernumerary temporary positions.
On the other hand, if the TN applicant is an employee of a U.S. management consulting firm, he or she may come in temporarily to fill an otherwise permanent position. This means that the TN applicant may attain a visa to provide services for the clients of the consulting firm.
It is important to understand that an individual seeking to qualify for a management consultant visa may fail if the submitted job description is not consistent with the TN management consultant occupation as defined by USMCA. Also, as per the new update, the US employment must be with a US employer or entity. This means that foreign companies doing business in the U.S. can no longer “sponsor” individuals for TN visas.
TN Visa Denials for Management Consultant Applications
As we mentioned earlier, the USMCA management consultant category is highly scrutinized and can be quite difficult to qualify for. In some cases, TN consultant visa applications will be denied altogether under circumstances that may include:
- The TN applicant for a management consultant position fails to provide documented proof describing the consulting nature of the work to be performed. Documentation must show that the position is for temporary consulting work. Job descriptions must reflect this by including language like “advise on restructuring,” “assess operations and advise on optimizing,” etc. Anything in the job description that suggests the individual will fill an ongoing managerial position will lead to a denial.
- TN applicant’s pay structure looks like that of a salaried employee. The Management Consultant’s terms of payment must reflect those of a temporary non-routine engagement. As such, a fixed biweekly or monthly salary, especially when accompanied by typical employee benefits (such as health and insurance payments, paid time off, and pension plans), can raise suspicion (that the individual is coming to fill a typical employee role and not as a temporary consultant). And such suspicion can lead to a denial.
- Failure to justify the time requested for the assignment to be completed. Adjudicating officers expect management consultants to be individuals hired by the U.S. company to help solve a particular short-term management problem. Thus, while TN visas are granted for up to three years, multi-year Management Consultant TN visa applications pose particular problems. Applications must demonstrate why they require a multi-year visa to help solve a “short-term” problem.
- TN applicant does not provide a qualifying educational degree or verifiable consulting experience. Candidates should provide a qualifying Baccalaureate or Licenciatura degree. Under the new rules, applicants with degrees obtained outside the US, Canada, or Mexico must submit an academic equivalency evaluation. Applicants without a degree must prove having five or more years of consulting experience. Individuals whose experience leans towards general management will be denied.
- There are discrepancies in the applicant’s documentation. Any inconsistency between the job description, support letters, and interview responses can reduce an applicant’s credibility, leading to a denial.
- TN applicant does not prepare well for the border interview. Many applicants say the wrong things during their TN visa interview, such as failing to clearly articulate the problem they’re being hired to help solve.
