How can I renew my TN Visa due to the Coronavirus (COVID-19)?

I am going for a job interview, do I request a Tourist or Business visa (B1/B2 visa)?

A company in the U.S. wants to fly me in to the office for a personal interview. I live in Canada and will apply for a TN Visa if they hire me. What do I say when I enter the U.S.? Do I state this trip is for business or pleasure and which visa do I ask for a B1 visa or B2 visa?


Answer:
This is a very good question. Always be truthful.

If you are visiting family or travelling for a week to see the sights and were asked to interview during this time, your intention at the time of entry was as a B2 tourist.

If the intention of your trip is primarily for the interview, then you would ask for the B1 Business visa. Having an invitation letter to interview is a good idea as well.

If you are going to combine this into a vacation, then this is a grey area and one should be careful. Usually, if you have prior knowledge of the interview, then it can be argued that it is still a business trip. Best to be honest with the Officer and explain you are doing both and they will issue the appropriate type of visa.

Question:

Will I have a problem with my TN Visa if I apply as a Software Engineer?

Answer:

The Engineering title is used by Immigration Officers as the traditional engineers (mechanical, electrical, etc). This can cause TN Visa applications potential issues and you should verify you meet the requirements for use of this title.

If you decide to use the term "Engineer" in your application, you will require additional supporting documents to show the Immigration Officer you meet their requirements.

Software Engineer, Computer Engineering, Engineering Technologist are sample job titles that should be used with care when applying for your TN Visa. This does not mean you should not use this title, just use it with care and be prepared.

Question:

What is the effective date of the USMCA? Can it still fail?

Answer:

As of November 2018, the USMCA also known as the New NAFTA 2.0 agreement or United States Mexico Canada Agreement is not yet law. 

The United States, Mexico and Canada have created a tentative deal and they are attempting to sign the deal before the Mexican President, Enrique Peña Nieto, leaves office Dec 01, 2018.

WHAT HAS TO HAPPEN BEFORE USMCA iS EFFECTIVE?

1. As mentioned earlier, the three countries need to sign the deal before December 01, 2018.

2. For the US, in July 2019 the Senate will vote on the USMCA Bill and decide its fate.

3. For Canada, Trudeau still needs to defend this agreement in front of the House of Commons. The House of Commons will vote on it and it will need to pass. Then it is sent to the Canadian Senate and debated. The Senate must also pass the bill. Prime Minister will attempt to do this and get it passed before October 2019.

4.  For Mexico, the process is quite quick once the President signs the deal before leaving office on December 01, 2018.

If the USMCA or new NAFTA 2.0 is not passed by any of the countries parliamentary process, the leaders will need to meet and discuss. There is a risk this may happen which can cause the USMCA effective date to be later than planned.

WHEN IS THE PLANNED USMCA EFFECTIVE DATE? 

If everything goes well, the three leaders have agreed to enact this agreement January 2020. Some parts of the agreement come into effect at a later date. But January 2020 is the date to remember.

What is USMCA or the New NAFTA 2.0 and what are the USMCA differences?

Answer:


This is what USMCA stands for: United States Mexico Canada Agreement.
This is being called: "New NAFTA", "NAFTA 2.0" or what Donald Trump has named: "The United States–Mexico–Canada Agreement" (USMCA).
This trade agreement is a renegotiation of the original North American Free Trade (NAFTA) agreement between the U.S., Mexico and Canada in October 2018.

The NAFTA 2.0 or USMCA is new agreement which is still pending and requires approval by the U.S. Congress. Once approved by all three countries, it is expected to become effective in 2020. 

Common USMCA Questions:
Is the USMCA a historic transaction? No.
Does USMCA benefit Americans. Yes.
Does USMCA benefit Canadians and Americans. Yes.

What are the differences between NAFTA and USMCA?
Most of the original NAFTA agreement has remained the same. The new NAFTA 2.0 or USMCA is Donald Trump's attempt to make things better for Americans.

Here are some of the major differences:

  1. Automobile requirements to qualify for zero tariff have been made stricter.
  2. Canada dairy export to the US subject to limits and tariffs. US dairy makers get more access to Canadian dairy market.
  3. Canada and Mexico cannot create trade deals with China without informing the US and the US can leave USMCA if a deal is struck.
  4. Dispute settlement between companies and governments in Chapter 11 has been severely restricted. Investors are not able to sue governments over policy changes that affect future profits.
  5. Currency manipulation is not allowed.
  6. Intellectual property protection extended to 70 years after the life of the auther.
  7. Digital content (music, ebooks, etc) not subjected to duties.
  8. Internet companies are not liable for content their users produce.
  9. Online cross border shipments to Canada worth less than $150 will not be subject to duties. The de minimus threshold has been raised from $20 to $40 for duties and taxes.
  10. A sunset clause was added. Review the agreement every six years and a 16 year term for the agreement, with the potential to be extended.


Does USMCA affect the TN Visa Application Process?
First and foremost, you should know the TN Visa requirements have not changed. Everything you need to do to obtain your TN Visa remains the same.

Is there a grace period after my TN Visa expiration?

Answer:

For your TN Visa expiration, there was an unofficial 10 day grace period and now there is a 60 day grace period. Read more below.

Previously there was no grace period after your TN Visa expired. As of January 17, 2017, if you have a TN Visa and your job ends or your TN Visa expires, you can stay an additional 60 days.

During these 60 days you are not allowed to work. You are allowed to:

  • close your affairs
  • look for a new job
  • you can file another TN Visa application 
  • you can file an extension or change of status
This grace period is similar to the H-1B visa grace period and make it much more easier for you as a TN Visa applicant to continue living and working in the U.S., Canada or Mexico.
 
There is additional great news with this ruling and that is a 10 day grace period has been approved prior to the start date of your TN Visa. This means you can officially enter the country 10 days before your start date and get settled in.
 

 


Question:

Are there any vacation restrictions while on TN visa? My employer has agreed to give me five weeks vacation over the summer.

Answer:

There are no vacation restrictions on TN Visa as long as you are on the payroll.
 
If you are not an employee during this time, that means your employment is terminated and you will need to apply when you return.

I was denied my TN Visa, can I try again at a different border crossing? Will I be denied again?

Do not do this! When your initial TN Visa request has been denied you don't want to simply reapply at a different border crossing (port of entry). When your TN Visa is denied, always ask the Immigration Officer questions and clarify exactly why they are denying your TN1 visa. Be polite. Be sure you understand why you are being denied. I filed the Form I-130 separately from I-485? Can I file my I-485 now, how do I do this?

Answer:

Filing the I-130 separately from the I-485 complicates your application and can lead to delays. The delay usually occurs since the I-130 will most likely be sent to National Visa Center (NVC) expecting an immigrant visa - which you have not filed and will not be filing. YOUR NEXT STEPS 1. Yes you can use the same number. Social Security numbers never expire. The SSN is assigned to you just like a Canadian Social Insurance Number (SIN).

Answer:

UPDATE: Due to the Supreme court action of overturning DOMA and Proposition 8, same sex marriages may now be allowed under NAFTA. We are waiting for additional information.  

Unfortanately civil unions, common-law are not recognized at this time under the North American Free Trade Agreement (NAFTA).

I am a US citizen and my spouse is overseas, should we apply for the K3 spouse visa or the CR1 spouse visa? We hear so many conflicting information. Also what are the processing times - how long will it take?

Answer:

Yes, there is a lot of misinformation about the K3 spouse visa and the CR1 spouse visa. Essentially, the K3 spouse visa was meant to be a much faster visa to bring your spouse into the U.S. but that is no longer the case due to recent changes with US Immigration. Secondly, the overall Green card cost using the K3 spouse visa route is more expensive since you pay for the K3 visa and the Adjustment of Status application. Do I need a TD Visa for my dependents when I apply for my TN Visa?

Answer:

You will need either a TD Status or a TD visa. You want to understand the difference between the TD (trade dependent) status vs. the TD visa.

Canadians do not need visas to enter the U.S. So any Canadian citizen dependents you have will only require the TD status which they will receive at the Port of Entry.

Non-canadian dependents will need to obtain a TD Visa at the U.S. embassy before entering the U.S.

Answer:

When you file for the adjustment of status your wife's children (under the age of 21) also qualify for the same preference and priority date.

You are able to file later for the stepchild but weary of the various age requirements and the time it takes to process the application. Your stepchild, as long as they were under 18 when you were married will be considered "immediate relatives" and are eligible for the green card as soon as you get through the application process.

When the U.S. petitioner does not meet the minimum income requirements, a sponsor is someone who agrees to use their resources and assets should the immigrant be unable to support themselves. The immigrant is not allowed to obtain certain federal, state or local specified public benefits since the sponsor has agreed to provide their resource to help the immigrant. If the immigrant does obtain these benefits, then the sponsor will need to repay it. A sponsor does not have to be a relative, but due to the commitment the sponsor is making in many cases it is a family member or close friend. You can use your new married name on your Adjustment of Status application even though your passport shows your maiden name. Your marriage certificate will be proof of the new name. Answer:

A lawyer can accompany you to the border for your TN Visa, but it is not required. Most TN Visa applicants cross the border on their own, whether they are using the TN Visa Expert Kit or they hired a lawyer.

The TN Visa does not have a NAFTA Occupation for chef or cook, but depending on your experience and the job you may qualify to work as a management consultant.

For the K1 Visa you must meet with one exception. There is a clause in the K1 visa which allows a U.S. citizen to claim extreme hardship but financial circumstances is very rarily if ever accepted.

Do I need to renew my TN Visa, if my passport is expiring soon?

Answer:

No. Your TN visa does not expire simply because your passport expires. Your TN Visa is good for the length of time issued. You should have the Form I-94 stating the duration. Keep this with you. Also, if you know you do not have to travel outside the country, you can renew your passport via mail and be fine. When traveling on your new passport keep the I-94 and old passport (just in case) with you.

I got my TN Visa, thank you! Now is there anywhere I could go in Southern California to renew my TN without having to leave the country?

Answer:

One TN Visa renewal option many Californians have is to drive to the San Diego - Tijuana border, park the car on the U.S. side and walk across into Mexico, turn around and apply upon re-entry. I'm on a TN Visa and heard about the I-797C receipt notice? What is the I-797C?

Answer:

The I-797C is something new. When a TN Visa holder files a TN Visa renewal via mail with the I-129 Form, they will receive an I-797C receipt that the I-129 has been filed and received by USCIS. Remember, this is not acknowledgement that you have been approved for a TN Visa.

Do I need a consulting agreement for my TN Visa as a Management consultant?

Answer:

Yes, in most cases you will need the TN Visa Application letter as well you may be asked to show the contract (or consulting agreement) with the U.S. employer. This does not apply to other NAFTA Occupations, just the Management Consultant.

What are the Adjustment of Status filing fees? I've heard so many different amounts, please clarify.

Answer:

The Adjustment of Status fees are as follows: $985 for Form I-485, $85 for biometric fee, and $420 for Form I-130 if your situation requires you to file this additional form.

What is Adjustment of Status Form I-485?

Answer:

Form I-485 allows foreigners who are in the U.S. to change their immigration visa status. This application is known as Adjustment of Status. This only applies to certain visa types. One can use it to get their green card for their fiance or foreign spouse.

Can I travel and leave the USA once I apply for the Adjustment of Status?

Answer:

Yes, but you must receive special travel permission called Advance Parole so you can return to the U.S. Processing time for the Advance Parole is between 30-90 days, similar to the EAD.

You are required to leave the U.S. However, you can apply to change your status (either by leaving and reentering, or filing a form via mail to the Immigration office) to a visitor which allows you to stay for up to 6 months.

Can I get a TN Visa after an H-1B visa? I have had two H-1B visas and now need to leave for one year. How can I get a TN Visa?

Answer:

Yes, you can get a TN Visa after the H-1B visa. You simply leave the country and upon re-entry apply for your TN Visa. Remember, the TN Visa has temporary intention, so you may have to show ties to Canada.

I was on a TN Visa but have been recently laid off. How can I get Unemployment Insurance?

Answer:

Collecting unemployment insurance for TN Visa holders has never been easier, but since the Jan 17, 2017 TN Visa 60 day grace period it is now possible for TN Visa applicants to collect unemployment insurance!

This is because unemployment insurance applications required the applicant to be "able and available for work". Prior, to the grace period, TN Visa holders were required to leave the country, now they can stay and continue looking for work. This allows them to also qualify for unemployment insurance!

Answer:

Can I apply for the TN Visa as a Software Engineer?

Answer:

Yes, but you have to create your Application carefully. A Programmer does not qualify for the TN Visa. But job duties as a systems analyst will allow you to obtain a TN Visa. I was approved for a TN Visa, which expires next month. I do not plan on renewing it, as I have returned to Canada early for another job. I have the white TN card stapled in my passport. How and when am I supposed to give it back?

Answer:

If a TN applicant returns to Canada before the TN Visa period ends and no longer is using their TN Visa, US Immigration needs to update their files for date of departure. Otherwise upon returning to the U.S. at a later date could raise questions. If one flew out of the country, it is more evident that one left the country. However, if one drives across the border there is no official record departure.

Do I qualify for the TN Visa, I am a chiropractor?

Answer:

For my TN Visa, I received a job with a recruiting firm. Initially they will pay my salary, then after 3 months I will be paid by the other company. Who should the employer letter be from?

Answer:

The TN Visa employer is the company hiring and paying your salary. The TN1 Visa Employer Letter is from the recruiting company. In 3 months, if the employer changes, you will apply for a new TN Visa with the same job description. A good tip: Apply for the TN based on immediate facts, not on future possibilities.


Question:

For hotel manager it says you need 3 years of experience to qualify for the TN1 Visa. Do you still need 3 years of experience even though your job may only require one or two years?

Answer:

You can must have what is required by NAFTA first and foremost. You can have either a degree in hotel management or a diploma/certificate in hotel management with 3 years experience. First, you do not say the word 'Sponsor' - since the TN Visa does not need a sponsor. This also scares employers and they think of the expensive H1B visa. It seems like your problem is what you are saying in your interview. What if you could say, "I'm Canadian, the visa is not a problem. Can I apply for the TN Visa with a copy of my TN Visa Employer letter?

Answer:

No. You must apply for the TN with the original TN Visa Employer letter. Do not risk being rejected. Have your employer Fedex the letter if necessary. This also applies to your degree - must be the original.

Can I travel and leave the U.S. while on a TN Visa?

Answer:

Yes! You can travel abroad while on a TN Visa. Remember to keep your Form I-94. Many travel agents accidentally take it from you at the ticket counter.

My job title is not on the NAFTA Job list, how do i know if it qualifies?

Answer:

One way is to determine if the job requires a degree that is on the NAFTA Job List. Not always the case, but it is a good start. If you have a degree, find the NAFTA Job Title that has a common degree and see if its job description is similar to your job role.

For my TN Visa, what if my job title does not match the NAFTA Occupation, do I still qualify?

Answer:

Yes. Your job title does not have to match the NAFTA Occupation. You want to ensure the educational requirements (if any) and the job description/duties meets the NAFTA Occupation requirements. You also want to ensure your TN Visa Application Letter is written correctly so the Immigration Officer can see how the job meets the NAFTA Occupation you are apply under.

No. When you lose your job, you no longer have a valid status to stay. You are required to leave the U.S. However, you can apply to change your status to a visitor which allows you to stay for up to 6 months.

NAFTA does not recognize common-law relationships for the TN Visa. You can obtain a TD Visa for your daughter but not your common-law spouse. At a minimum you will need to have a civil marriage.

I have finished my degree, but have not received the official degree document. Can I still obtain a TN Visa?

Answer:

Maybe. Officially, you require your degree for the TN Visa and this is what the Immigration Officer looks for.

The TN Visa is a very subjective process and since this situation is not clearly defined one can attempt to cross and apply knowing that you may be requested to come back at a later date with your official degree.

To increase your chances of success have the TN Visa Application, letter from your faculty that you graduated as well as your official transcripts.

How do I get my Social Security Number? Do I need to get it before obtaining the TN Visa?

Answer:

1. Download and complete the Social Security Application Form. (Form SS-5)

Note: You can start working without an SSO number, since you have your TN as proof that you are authorized to work. An employer can pay you without this number or you can wait to have them pay you once your number arrives.

After Your TN Visa Expires, Lost Your TN Visa Job, Switch Jobs
Your Social Security Number is still valid after your TN expires, your job ends or you switch jobs. If you found another TN Visa job, you would use the same Social Security Number. This number belongs to you. If you use it without a valid TN Visa, then you are working illegally which you should not do.

I was wondering if I can fly into San Francisco (SFO) or Los Angeles (LAX) airport directly from Asia (or Europe) and get my TN stamp at the airport.

Yes, LAX and SFO process TN NAFTA Visas if this is your first Port of Entry. Usually there is an Immigration Officer knowledgeable about TN visas on duty. Try to schedule a flight that arrives into the U.S. during regular business hours so the chances of an Immigration Officer with TN NAFTA visa experience being available is more likely.

Is the TN Visa valid for 1 year or 3 years?

Answer:

The TN Visa is now valid for 3 years. As of Oct 2008, US Citizenship and Immigration has increased the length of time a TN applicant can stay. Remember, to request this in your TN Visa Application Letter.

If I am getting a fulltime job, do I need to have my employer specify in my contract it is only for 3 years due to the TN requirement?

Answer:

No. There is a difference between an employment contract and the TN Application Letter. You will create a TN Application Letter to explain to the Immigration Officer how you and the job meet the NAFTA requirements. This will have the 3 year term specified. At the end of the 3 years, if your employer wants to keep you on, you will create another TN Application Letter and request another 3 year TN Visa. Your employment contract will not change. I have been on a TN Visa working as a W2 employee. Now i have a chance to work at another company as a 1099 contractor. Can I obtain the TN Visa on a 1099?

Answer:

Yes, but the 1099 is a little tricky since its for contractors and freelancers. You can do it as long as you operate as yourself using your SSN number and US Immigration can see that you are employed by that company. Your TN Letter will state that this company is employing you, which meets the NAFTA requirements. Opening your own corporation and doing a TN through this business may not be considered valid and can raise concerns.

Can an LLC company hire an employee or contractor under the TN Visa.

Answer:

Yes they can. You just need to ensure the person meets the TN1 Visa Requirements and your job requires a person with a degree as listed in the NAFTA Job List.
