    TN Visa Frequently Asked Questions

    Question:

Are there still TN Visa Jobs due to Coronavirus?

    Answer:

Yes, there are TN Visa jobs during this Coronavirus pandemic.

You have to know where to look. We will show you how COVID-19 is creating opportunities your industry. Read on and we will tell how to do this.

It's true many companies are affected. Companies in retail, leisure, travel and tourism industry have been most impacted. Many companies are affected as people avoid public places such as restaurants, theaters, offices, shopping malls and more.

Companies have furloughed many employees (leave of absence). When you hear of this, look at which industry the company falls into. Is it an industry mentioned above? Do not worry - there are a lot of other industries affected less.

The TN Visa is an immigration visa for professionals. Most of the USMCA/NAFTA jobs applicants apply for are not in the service industry.

    TN Visa Job Opportunity Areas

Companies are in an initial shock and this is an opportunity for you. As companies overcome this shock of the Coronavirus, they will start dealing with the reality of it.

They will see opportunities in the following areas and so should you:

    • Updating their website for COVID-19, send communications out to their customers
    • Updating their website for COVID-19, sending communications out to their customers
    • Opportunity for online training, tutorials, remote learning
    • Planning for shortages in their workforce due to Coronavirus sickness
    • Ensuring critical business workflows continue to operate (hiring a backup workforce)
    • Surge in COVID related work (medical support, technicians, website modifications, systems analyst, designers, software development, research, etc.)

Employers are starting to plan for 60% of their workforce to get infected. As their employees get infected with the Coronavirus, there will be a shortage of workers. Companies will be left scrambling if they didn't plan for it. This is an opportunity for you.

With the population self-isolating and quarantined, everyone is looking to the Internet to assist them. Employers are figuring out how to deliver their products and services online, remotely. Some companies, such as Amazon is seeing a surge in demand and is hiring. You may think these are warehouse jobs, jobs for drivers, etc.

This is true, but if you think bigger, they will need professionals to manage this growth and this large labor force. Are you able to find opportunities in this and start applying?

Take Action - Get Ahead of Other Applicants

Companies need to survive and are adaptable - just like us. They are looking for opportunities to generate revenue and keep moving forward. For example, companies were scrambling to get their websites updated due to Coronavirus during March. Many websites you visit have a comment or a section about their response to COVID-19. Some are scrambling while others have moved to the next stage of opportunities. Start thinking now of how you can assist. Find these jobs and apply.

If you were thinking of waiting to apply, don't. Stay ahead of the game. As people are in survival mode and emotional turmoil, you can rise above it and find your opportunities.

If you wait long, this will become obvious to everyone and you will have missed your chance. Most companies have started hiring a team of people to manage their website content related to Coronavirus.

Were you ready for this? If not, don't miss out on the other opportunities.

    Question:

How can I renew my TN Visa due to the Coronavirus (COVID-19)?

    Answer:

The Coronavirus situation is affecting new TN Visa applications as well as TN renewals, here is what you can do. Due to the increase in Coronavirus cases being found by the Canadian, US and Mexican government, they are implementing strong measures related to immigration visa processing, border crossing and airport restrictions and flight cancellations. TN Visa Renewal / Extension of Status for Canadians Safest Option

    • Canadians can file their TN Visa renewal by mail by submitting USCIS Form I-129.
    • Under normal circumstances, this was taking approximately 3-4 months to be approved, with the Coronavirus situation, be prepared for this to take longer.
    • Applications can be filed up to six months in advance, so file earlier!
    • Once filed prior to your TN Visa / I-94 expiration date, the applicant can continue to work past their expiration date while USCIS is processing the application.
    • You will need to submit a complete TN Visa Application in addition to the I-129 Form.
      Alternative Option
    • All "non-essential" travel is restricted.
    • TN Visa applications are considered essential travel. This is good news.
    • With the new Mar 21, 2020 essential travel restrictions, TN Visa applicants were not sure if they could cross the border. We have
    • Though Work travel is considered essential, renewing by mail is a very good option. You avoid travel, you avoid possibly getting infected as well as avoiding a denial.
    • Canadians can attempt to submit their application at airports or border crossing but do so with care.
    • We have TN Visa Expert customers who have obtained their TN Visa at the border during the first week of April. This is great news!

    Question:

I am going for a job interview, do I request a Tourist or Business visa (B1/B2 visa)?

    Answer:

    Allison’s Full Question:
A company in the U.S. wants to fly me in to the office for a personal interview. I live in Canada and will apply for a TN Visa if they hire me. What do I say when I enter the U.S.? Do I state this trip is for business or pleasure and which visa do I ask for a B1 visa or B2 visa?

    Answer:
This is a very good question. Always be truthful.

If you are visiting family or travelling for a week to see the sights and were asked to interview during this time, your intention at the time of entry was as a B2 tourist.

If the intention of your trip is primarily for the interview, then you would ask for the B1 Business visa. Having an invitation letter to interview is a good idea as well.

If you are going to combine this into a vacation, then this is a grey area and one should be careful. Usually, if you have prior knowledge of the interview, then it can be argued that it is still a business trip. Best to be honest with the Officer and explain you are doing both and they will issue the appropriate type of visa.

If you still have questions, you should get them answered so you are prepared to answer the Immigration Officer's questions. Setup a phone consultation, the first 5 minutes are free.

    Question:

Will I have a problem with my TN Visa if I apply as a Software Engineer?

    Answer:

The Engineering title is used by Immigration Officers as the traditional engineers (mechanical, electrical, etc). This can cause TN Visa applications potential issues and you should verify you meet the requirements for use of this title.

If you decide to use the term "Engineer" in your application, you will require additional supporting documents to show the Immigration Officer you meet their requirements.

Software Engineer, Computer Engineering, Engineering Technologist are sample job titles that should be used with care when applying for your TN Visa. This does not mean you should not use this title, just use it with care and be prepared.

This is explained in more detail in the TN Visa Expert Kit - Platinum Edition.

Read the Step by Step instructions and the Appendix of TN Visa considerations for Special Job Titles for NAFTA.

Move with care and do not try to be hasty. NAFTA has certain requirements, ensure you both meet them each time you engage with a new US client.

Consider downloading the TN Visa Expet Kit to create your Application correctly.

    Question:

What is the effective date of the USMCA? Can it still fail?

    Answer:

As of November 2018, the USMCA also known as the New NAFTA 2.0 agreement or United States Mexico Canada Agreement is not yet law.

The United States, Mexico and Canada have created a tentative deal and they are attempting to sign the deal before the Mexican President, Enrique Peña Nieto, leaves office Dec 01, 2018.

WHAT HAS TO HAPPEN BEFORE USMCA iS EFFECTIVE?

    1. As mentioned earlier, the three countries need to sign the deal before December 01, 2018.

    2. For the US, in July 2019 the Senate will vote on the USMCA Bill and decide its fate.

    3. For Canada, Trudeau still needs to defend this agreement in front of the House of Commons. The House of Commons will vote on it and it will need to pass. Then it is sent to the Canadian Senate and debated. The Senate must also pass the bill. Prime Minister will attempt to do this and get it passed before October 2019.

    4.  For Mexico, the process is quite quick once the President signs the deal before leaving office on December 01, 2018.

If the USMCA or new NAFTA 2.0 is not passed by any of the countries parliamentary process, the leaders will need to meet and discuss. There is a risk this may happen which can cause the USMCA effective date to be later than planned.

WHEN IS THE PLANNED USMCA EFFECTIVE DATE?

If everything goes well, the three leaders have agreed to enact this agreement January 2020. Some parts of the agreement come into effect at a later date. But January 2020 is the date to remember.

    Question:

What is USMCA or the New NAFTA 2.0 and what are the USMCA differences?

    Answer:

This is what USMCA stands for: United States Mexico Canada Agreement.
This is being called: "New NAFTA", "NAFTA 2.0" or what Donald Trump has named: "The United States–Mexico–Canada Agreement" (USMCA).
This trade agreement is a renegotiation of the original North American Free Trade (NAFTA) agreement between the U.S., Mexico and Canada in October 2018.

The NAFTA 2.0 or USMCA is new agreement which is still pending and requires approval by the U.S. Congress. Once approved by all three countries, it is expected to become effective in 2020.

    Common USMCA Questions:
Is the USMCA a historic transaction? No.
    Does USMCA benefit Americans. Yes.
Does USMCA benefit Canadians and Americans. Yes.

What are the differences between NAFTA and USMCA?
Most of the original NAFTA agreement has remained the same. The new NAFTA 2.0 or USMCA is Donald Trump's attempt to make things better for Americans.

Here are some of the major differences:
Remember, we are giving you very high level view of these differences, you can read them in more details online.

    1. Automobile requirements to qualify for zero tariff have been made stricter.
    2. Canada dairy export to the US subject to limits and tariffs. US dairy makers get more access to Canadian dairy market.
    3. Canada and Mexico cannot create trade deals with China without informing the US and the US can leave USMCA if a deal is struck.
    4. Dispute settlement between companies and governments in Chapter 11 has been severely restricted. Investors are not able to sue governments over policy changes that affect future profits.
    5. Currency manipulation is not allowed.
    6. Intellectual property protection extended to 70 years after the life of the auther.
    7. Digital content (music, ebooks, etc) not subjected to duties.
    8. Internet companies are not liable for content their users produce.
    9. Online cross border shipments to Canada worth less than $150 will not be subject to duties. The de minimus threshold has been raised from $20 to $40 for duties and taxes.
    10. A sunset clause was added. Review the agreement every six years and a 16 year term for the agreement, with the potential to be extended.

Does USMCA affect the TN Visa Application Process?
First and foremost, you should know the TN Visa requirements have not changed. Everything you need to do to obtain your TN Visa remains the same.

What has changed is the Border Officers are being more strict in their evaluation of your TN Visa application and asking more questions. If you qualify and you use the TN Visa Expert Kit - Platinum Edition to prepare your application you will be fine.

Since Nov 2017 when Trump started negotiating the NAFTA / USCMA deal, we have had over 2000 applicants successfully obtain their TN Visa using the TN Visa Kit. So do not worry, follow the step by step instructions and read the border preparation chapter so you know what do do and what not to do and say. Also, study the border questions we have listed in the TN Visa Kit Platinum Edition so you can clearly answer the Border Officer's questions calmly and clearly to avoid raising any scrutiny.

    Question:

Is there a grace period after my TN Visa expiration?

    Answer:

For your TN Visa expiration, there was an unofficial 10 day grace period and now there is a 60 day grace period. Read more below.

Previously there was no grace period after your TN Visa expired. As of January 17, 2017, if you have a TN Visa and your job ends or your TN Visa expires, you can stay an additional 60 days.

During these 60 days you are not allowed to work. You are allowed to:

    • close your affairs
    • look for a new job
    • you can file another TN Visa application
    • you can file an extension or change of status
This grace period is similar to the H-1B visa grace period and make it much more easier for you as a TN Visa applicant to continue living and working in the U.S., Canada or Mexico.

There is additional great news with this ruling and that is a 10 day grace period has been approved prior to the start date of your TN Visa. This means you can officially enter the country 10 days before your start date and get settled in.

    Question:

Are there any vacation restrictions while on TN visa? My employer has agreed to give me five weeks vacation over the summer.

    Answer:

There are no vacation restrictions on TN Visa as long as you are on the payroll.

If you are not an employee during this time, that means your employment is terminated and you will need to apply when you return.

    Answer:

There is no minimum salary or income requirement under the NAFTA TN Visa, but the Immigration Officer does question low salaries.

    Question:

I am on a TN Visa and have a boyfriend in the U.S. Will I get denied my TN Visa?

    Answer:

One requirement is to show "non-immigrant" intent, or the intention to eventually return to your home country.

Click here if you have been denied your TN Visa

Proving intent is not easy and depending on how you convey the seriousness of the relationship, will play a part in your TN visa requirements.

For example, if you are engaged, wearing a ring and applying for your TN visa or crossing the border as a visitor - the Officer's suspicions may be aroused.

    Question:

I overstayed on my visa and recently married an American citizen. Can we file for the Adjustment of Status or will I have problems obtaining my Green card?

    Answer:

In most cases one is able to apply for the Adjustment of Status, but it will depend on which visa you entered the U.S. on as well as how long you overstayed.

When someone overstays by 180 days more problems can arise.

Email us at info@tnvisaexpert.com to determine if you can apply for your adjustment of status without having problems.

Remember to always be honest about your overstay during your application and provide the correct supporting documentation as required by USCIS. Lying can get you in more trouble.

    Question:

I am a US citizen and my spouse is overseas, should we apply for the K3 spouse visa or the CR1 spouse visa? We hear so many conflicting information. Also what are the processing times - how long will it take?

    Answer:

Yes, there is a lot of misinformation about the K3 spouse visa and the CR1 spouse visa.

Essentially, the K3 spouse visa was meant to be a much faster visa to bring your spouse into the U.S. but that is no longer the case due to recent changes with US Immigration.

Secondly, the overall Green card cost using the K3 spouse visa route is more expensive since you pay for the K3 visa and the Adjustment of Status application.

The CR1 spouse visa takes about a month longer than the K3 spouse visa and your spouse gets the Green card immediately upon arrival into the U.S. This means the costs are less since you do not have to file for the Adjustment of Status and incur those costs.

Important: Be careful. The CR1 spouse visa has multiple steps and numerous forms, if you make a mistake it can delay your approval by 3-6 months or more.

Email us at info@tnvisaexpert.com to get support through this process.

    Question:

Do I need a TD Visa for my dependents when I apply for my TN Visa?

    Answer:

You will need either a TD Status or a TD visa. You want to understand the difference between the TD (trade dependent) status vs. the TD visa.

Canadians do not need visas to enter the U.S. So any Canadian citizen dependents you have will only require the TD status which they will receive at the Port of Entry.

Non-canadian dependents will need to obtain a TD Visa at the U.S. embassy before entering the U.S.

Use the TN Visa Expert Kit to help you prepare your TN Visa Application as well as the supporting documents for your your TD visa dependents.

I am applying for a K1 visa and my fiance has an 18 year old child. Will her child qualify for the K2 visa?

    Answer:

USCIS allows unmarried children under 21 years old to qualify for the K2 visa. So your fiance's child will qualify if they have never been married.

Normally, for the Adjustment of Status the requirement is that the child is under 18 when the marriage takes place, but this rule does not apply for K2 child applicants under the K1 fiance visa application.

Under the Child Status Protection Act of 2002 (CSPA), the children for K1/K2 visa applications may be covered if they turn 21 while their Adjustment of Status is pending.

In most cases USCIS has expedite criterias and in most cases a pregnancy does apply unless it causes severe financial loss or is an extreme emergent situation.

    Your options are:
    1. Submit your K1 visa application as quick as possible. With the Visa Streamline System K1 Visa Service you can get your application prepared in as little as 3 days.

In most circumstances, your fiance will fly after the baby is born and your new baby will obtain the K-2 visa.

Use the Visa Streamline System - K1 Fiance Visa service to get started for this situation.

    2. Get married now and apply for the K3/CR1 spouse visa.
This is also a viable option. The big difference here is you will be able to have your baby's birth registered abroad as a U.S. citizen (much easier to do when you are married rather than engaged).

Use the Visa Streamline System - K3/CR1 Spouse Visa service to help you with your application.

Can I change jobs with my TN Visa? I found a new job.

    Answer:

Yes, you can change jobs on a TN Visa but do it with care.

Since one can hold multiple TN visas, many TN applicants will stay at their old job until they obtain the TN Visa (in person) for their new job and then quit their old job. This helps to ensure they can continue to stay in the U.S. if their new TN visa application is denied.

Applying by mail does not allow you to do this.

If you are changing jobs, you can obtain a TN Visa by either:
    1. Filing Form I-129 Petition for a Nonimmigrant Worker.

    2. Applying in person at a port of entry.

Use the TN Visa Expert Kit to help you quickly create your TN Visa application.

    Answer:

Average processing/wait time for a K1 fiance visa is 4-7 months. A K3 spouse visa takes around 8 months.

The US Embassy in Montreal, Canada seems to be scheduling marriage interviews 4 months out. So be prepared to wait. For your sanity, don't plan too much during these 4-7 months. Once you receive your interview date, make sure you do not miss it otherwise you'll be waiting a long time again.

Important: We have had people contact us who did the application themselves and are experiencing processing times of 10-24 months because they made a mistake or missed including all the supporting documents. 4. You have all the correct supporting documents

    Question:

I am in Palau and the U.S. embassy in my country does not process K1 fiance visas. Where do I go for my K1 visa?

    Answer:

You go to the closest U.S. embassy. For citizens of Palau, you will the U.S. Embassy in Manila. To confirm, go to your countries U.S. Embassy page and click "Immigrant visas" - it will state the closest embassy for your K1 fiance visa.

    Question:

When can I cross the border for my TN Visa? Can I cross the border 3 weeks before my start date and get my TN1 Visa.

    Answer:

As explained in the TN Visa Expert Kit, it is reasonable for a person to cross the border approximately 1 week before starting their job. This allows you to get settled in and then start working.

It is important to understand you should request the TN Visa when you are ready to move to the US, not simply to cross the border, obtain the TN Visa and then return to Canada for a period of time. Most Immigration Officers will deny your TN visa request and tell you to come back when you are ready to move.

Remember, to have all your documentation complete and be prepared for the informal border interview. If you are not prepared, the Immigation Officer will deny you. 20% of all initial applications are denied. Most people are denied because their documentation did not correctly show how they and the job qualify for the TN Visa.

The initial TN Application is a set of free form documents showing how you qualify for the TN under NAFTA which you will submit at the border.

The common documents that are usually required when applying for the TN at the border include:

    1. TN Visa Application letter (see sample application letters)
    2. Original Degree
    3. Supporting documents
    4. Marriage certificate if applying for a TD Visa

When you renew your TN Visa in 3 years, if you decide to do it via mail then you will use the I-129 Form.

    Question:

I am applying for my marriage visa (adjustment of status) and I am very worried if the immigration officer will think I am committing marriage fraud since we only have known each other such a short time. What can I do to avoid this and stay married and get my wife's green card?

    Answer:

US Immigration Officers zealously examine all individuals seeking immigration benefits based upon their marriage to a United States Citizen.

Unfortunately, sometimes they are overzealous in their suspicion of immigration fraud and couples in good faith relationships get caught up in an immigration spider web.  Simply telling an immigration official that you have a good faith relationship is not enough, they can deny you entry into the U.S.

I am applying for a K3 spouse visa. I do not want to tell them that I applied for student visa in 2006 and was refused because I'll have to give them details which I've lost even I do not know the date when I applied for student visa.

    Answer:

When applying for a marriage visa, you can't hide any previous visa refusals. They would appreciate the honesty. If you meet the requirements for the type of marriage visa you are applying for now (and you are able to explain the previous denial), there might be a chance for obtaining the marriage visa.

    Question:

How long do we need to wait to apply for the Adjustment of Status. I entered the U.S. with a tourist visa and have now decided to marry my boyfriend, a U.S. Citizen. Can we start the Green Card process in the United States?

In some situations you may be able to apply immediately for your adjustment of status.

    Question:

I am applying for my TN Visa as a Management Consultant. What should I be careful of?

    Answer:

The TN Visa for Management Consultant is highly scrutinized. If your application letter shows you as an employee simply working 9 to 5, this is a red flag and possible cause for denial. The job decription should show you as a consultant, analyzing current situation and helping to improve the company's structure, efficiency and/or profits. Read more

    Question:

Does being married to an American a guarantee getting a marriage visa?

    Answer:

Applicants often think that being married is a guarantee to get a marriage visa and then a Green card. Marrying does not assure visa issuance. Marriage is simply a piece of paper from an immigration standpoint. What is important is that you have a genuine and sincere relationship. The strength of the relationship will be examined carefully, not so much whether you married or not. Generally, the more time you spend together as a couple is best. People who spend a great deal of time together tend to behave like a couple and are settled. Not everyone has the luxury of frequent or extended travel, so just do the best you can do. Then we can help you get your Green card. Read more about the K3 Spouse Visa

    Question:

Do I need to renew my TN Visa, if my passport is expiring soon?

    Answer:

Keep this with you. Also, if you know you do not have to travel outside the country, you can renew your passport via mail and be fine. When traveling on your new passport keep the I-94 and old passport (just in case) with you.

Collecting unemployment insurance for TN Visa holders has never been easier, but since the Jan 17, 2017 TN Visa 60 day grace period it is now possible for TN Visa applicants to collect unemployment insurance!

This is because unemployment insurance applications required the applicant to be "able and available for work". Prior, to the grace period, TN Visa holders were required to leave the country, now they can stay and continue looking for work. This allows them to also qualify for unemployment insurance!

IMPORTANT: How to Interview so Employer's agree to getting you a TN Visa

    Question:

Do I apply for the TN Visa as a NAFA Engineer occupation? I am getting a Computing Science degree and have a job for a Software Engineer.

    Answer:

Depends. You choose your NAFTA role based on your degree, the degree the job requires and the job duties. Both should match up. In most cases, a computing science degree means you apply as a System Analyst. The TN Visa Expert Kit will help you with custom sample letters and further explanation.

    Question:

Can I apply for the TN Visa as a Software Engineer?

    Answer:

Yes, but you have to create your Application carefully. A Programmer does not qualify for the TN Visa. But job duties as a systems analyst will allow you to obtain a TN Visa. Also, Software Engineer is usually reserved for jobs requiring an Engineering degree. Create your TN Visa Application Letter with caution. Use custom sample letter in the TN Visa Expert Kit to help you with this.

    Question:

I was approved for a TN Visa, which expires next month. I do not plan on renewing it, as I have returned to Canada early for another job. I have the white TN card stapled in my passport. How and when am I supposed to give it back?

    Answer:

If a TN applicant returns to Canada before the TN Visa period ends and no longer is using their TN Visa, US Immigration needs to update their files for date of departure. Otherwise upon returning to the U.S. at a later date could raise questions. If one flew out of the country, it is more evident that one left the country. However, if one drives across the border there is no official record departure.

Take the I-94 card with you on your next entry into the U.S. but also have supporting documentation showing when you left the country previously. Use this article: Forgot to Return TN Visa I-94 as a guide to assist you.

I can start working within a week" -- That's what the TN Visa allows you to do. We explain how to do this in the TN Visa Expert Kit Platinum Edition

    Answer:

No, it depends on whether this is your initial TN Visa or a TN Visa Renewal.

    1. For your first TN Visa, you need to create a free form TN Visa Application with supporting documents and you need to apply upon crossing the border.

The TN Visa Expert Application Kit provides you all the information you need for the Application and the supporting documents.

    Question:

Where can I get the TN Visa application forms?

    Answer:

Your first TN Visa Application does not have any predefined government application forms. This is why you must be careful and create your application correctly. If you do not provide the correct information, the Immigation Officer will deny you. 20% of all initial applications are denied.

    4. Marriage certificate if applying for a TD Visa.

    Question:

Can I work remotely for a U.S. employer from Canada. My TN Visa is expiring and my employer will let me work from Canada. Is this legal?

    Answer:

Yes. Your employer can pay you as an independent contractor or a corporation if you incorporate in Canada. This way they do not have to worry about withholding taxes, medical, etc. You will have to do this yourself.

    Question:

I am on an F-1 student visa getting my doctorate degree and have an OPT option. Can I begin the employment on a TN Visa rather than the OPT option?

    Question:

I have finished my degree, but have not received the official degree document. Can I still obtain a TN Visa?

    Answer:

Maybe. Officially, you require your degree for the TN Visa and this is what the Immigration Officer looks for.

The TN Visa is a very subjective process and since this situation is not clearly defined one can attempt to cross and apply knowing that you may be requested to come back at a later date with your official degree.

To increase your chances of success have the TN Visa Application, letter from your faculty that you graduated as well as your official transcripts.

Having as much documentation showing you've completed the degreed program will work in your favor.

    Question:

How do I get my Social Security Number? Do I need to get it before obtaining the TN Visa?

    Answer:

You obtain your Social Security after you receive your TN Visa. Once you have your TN Visa go to the nearest Social Security Office and submit your forms. You can find the nearest SSO office here.

How to apply for your Social Security Number

    1. Download and complete the Social Security Application Form. (Form SS-5)

    2. Gather Supporting Documents (Passport, TN Visa, drivers license). Read more about the documents required.

    3. Mail or submit your documents to the nearest SSO office.

Note: You can start working without an SSO number, since you have your TN as proof that you are authorized to work. An employer can pay you without this number or you can wait to have them pay you once your number arrives.

After Your TN Visa Expires, Lost Your TN Visa Job, Switch Jobs
Your Social Security Number is still valid after your TN expires, your job ends or you switch jobs. If you found another TN Visa job, you would use the same Social Security Number. This number belongs to you. If you use it without a valid TN Visa, then you are working illegally which you should not do.

You will create a TN Application Letter to explain to the Immigration Officer how you and the job meet the NAFTA requirements. This will have the 3 year term specified. At the end of the 3 years, if your employer wants to keep you on, you will create another TN Application Letter and request another 3 year TN Visa. Your employment contract will not change. Use the TN Visa Expet Kit to create your Application Letter correctly.
